Terms of Service
Last updated
1. The agreement
These terms are the agreement between you and TridentData LLC(“we”, “us”), 30 N. Gould St. Ste R, Sheridan, WY 82801, USA, for Marqent Design Studio and the sites it publishes (together, “the Service”). Marqent is a product of TridentData LLC. Creating an account, or using the Service, means you accept them. If you are accepting on behalf of a company or another organization, you confirm you are able to bind it, and “you” means that organization.
The Privacy Policy says what we do with your data and is part of this agreement.
2. Your account
You must be at least 16 and able to enter a binding contract. Give us accurate details and keep them current; keep your password to yourself. What is done from your account is done by you, so tell us at once if you think someone else has used it.
An organization is owned by the person who created it. The owner can invite members, remove them, and is responsible for what they do inside it. A workspace belongs to its organization, and everyone in a workspace can see and change everything in it.
3. What the Service does
You describe what you want; an AI agent builds and edits a real website for you, and you publish it. The agent writes code, text and images, fetches pages you point it at, and changes what it built when you ask. It works from your instructions and from the material you give it.
The agent is a machine. It can misread a request, write something wrong, or produce a page that looks nothing like what you meant. Everything it makes is shown to you before it is published, and reviewing it is your job: you decide what goes live, and you are responsible for what does.
We change the Service as we build it. Features are added, changed and occasionally removed. We will give notice before removing something you rely on, where we can.
4. Your content
What you upload or write into the Service — text, images, video, documents, brand material — is yours. You give us the permission we need to store it, process it, show it to the agent and to the members of your workspace, and publish it where you tell us to. That permission ends when you delete the content or your account, except for copies that remain in backups for a bounded time.
You are responsible for having the right to use what you upload. Do not give the Service anything you are not allowed to use, or anything that infringes someone else’s rights.
5. What the agent makes
As between you and us, what the agent produces for you — the pages, the copy, the images, the code — is yours to use however you like, and we claim nothing in it. Two things follow from how it is made:
- The models behind the agent are trained on a great deal of material, and a similar request from someone else may produce a similar result. We do not promise that anything the agent makes is unique or that it can be protected as your own.
- The agent can produce text that is inaccurate, images that resemble real people or marks, and code that has bugs. Check what it made before you rely on it, and do not present its output as fact without verifying it.
The templates, components and designs the Service starts a site from are ours or licensed to us. You may use them in sites you build with the Service; you may not extract them to use elsewhere.
6. Acceptable use
Do not use the Service to:
- break the law, or help someone else to;
- publish material that is defamatory, deceptive, harassing, sexually explicit involving minors, or that incites violence;
- infringe anyone’s copyright, trademark, privacy or other rights;
- impersonate a person or an organization, or publish a site that pretends to be one it is not;
- distribute malware, run phishing, or send unsolicited mail;
- probe, overload or interfere with the Service or the infrastructure behind it, or reach parts of it you were not given access to;
- resell the Service or use it to build a competing one by copying it.
We may take down a site, or suspend an account, that we reasonably believe breaks these rules, and we will tell you when we do unless the law forbids it.
7. Published sites and domains
A site you publish is served from our infrastructure, at an address under a domain we control and, if you connect one, at a domain of your own. You must control any domain you connect. We may move a site to a different address on our domain with notice, and we may stop serving a site under section 6 or when the account that owns it ends.
Your site’s visitors are your visitors. What your site says, collects and promises is yours to answer for, including its own privacy policy and any consent it needs.
8. Credits and plans
Work the agent does is metered in credits. Each plan grants a number of them, together with limits on sites and members; the current plans, what each turn costs and your remaining balance are shown in your organization’s settings. A credit is spent when the work it paid for is done, whether or not you keep the result, and spent credits are not refunded.
Prices and plan limits can change. A change to a paid plan takes effect at the start of your next billing period, and we will tell you before it does. Unused credits from a monthly grant do not carry over unless the plan says they do.
9. Third-party services
The Service runs on providers we do not control, including the AI model providers, the sandbox in which the agent works, and the network that serves your sites. They are listed in the Privacy Policy. An outage or a change on their side can affect the Service, and their terms apply to what they process.
10. Ending the agreement
You can stop using the Service at any time and ask us to delete your account. We can suspend or end your account if you break these terms, if the law requires it, or if we stop offering the Service, in which case we will give you as much notice as we reasonably can and a chance to take your content with you.
When the account ends, sites it owns stop being served and its content is deleted as the Privacy Policy describes. Sections 4, 5, 11, 12, 13 and 14 survive.
11. Disclaimers
The Service is provided as it is and as it is available. We do not promise that it will be uninterrupted, error-free or fit for a particular purpose, that the agent’s output will be accurate, lawful or useful, or that a site it builds will achieve any result — search ranking, traffic, or sales included. To the extent the law allows, we disclaim every warranty not stated in these terms.
12. Limitation of liability
To the extent the law allows, we are not liable to you for lost profits, lost data, lost business or any indirect or consequential loss arising from the Service, and our total liability for anything arising from this agreement is limited to what you paid us in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing in these terms limits liability that cannot lawfully be limited.
13. Indemnity
If a third party makes a claim against us because of your content, a site you published, or your use of the Service in breach of these terms, you will cover the cost of it — the claim itself and the reasonable expense of defending it.
14. Governing law and disputes
These terms are governed by the laws of the State of Wyoming and the United States, without regard to conflict-of-law rules. If there is a dispute between us, we will first try to settle it informally: either side may write to the other describing the problem, and the two of us will have sixty (60) days from that notice to resolve it. What is not resolved that way is settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, and the prevailing party’s reasonable legal costs are borne by the other. Either side may still ask a court for an injunction to protect its intellectual property, and nothing here takes away a right that your local consumer law does not allow to be waived.
15. Changes to these terms
We may change these terms. When we do, the date at the top changes, and for a change that affects your rights we will tell you inside the product or by email before it takes effect. Using the Service after that date means you accept the change; if you do not, stop using the Service and ask us to delete your account.
